Choosing the right business school is the most critical career shaping decision for management aspirants but with all the glitz, publicity and virtual showcasing, an aspirant today is a bundle of confusion and making the right choice becomes a nightmare. Thus, in first of its kind move in India with the objective of ushering transparency and to enable management aspirants to make an informed choice, JKBS conducted the innovative and highly appreciated campus-stay program over the weekend where scores of aspirants from many states including Delhi NCR, Punjab, Rajasthan, MP, Bihar and Orissa participated.

JKBS had left no stone unturned, including a pickup and drop facility, to make it a comfortable experience for the students. The night stay at the hostel was the first time some of the participants had stayed away from home and they enjoyed the experience.

The innovative and intensive day-night programme started at JKBS sprawling campus in Gurgaon with an interactive session with the faculty and alumni where they were informed about JKBS academic program, internships, events and placement opportunities. This was followed by soft-skill training session. There upon, aspirants were given a detailed tour of the campus facilities.

In the evening, aspirants were invited to participate in games and club activities and also interact freely with student leaders. The experience was complete with night stay at the hostel.

Sterling and Wilson Pvt. Ltd., part of Shapoorji Pallonji Group and one of India’s leading solar EPC companies with over 350 MW of solar projects spread across 13 states is close to commissioning more than 140 megawatts (MW) of solar power generation plants in India for the financial year 2014 – 2015. The Solar Photovoltaic power plant projects have been developed by Sterling and Wilson for various private sector institutions across Maharashtra, Madhya Pradesh, Tamil Nadu, Karnataka, Andhra Pradesh, and Telangana.
 
According to Sterling and Wilson, the cumulative power output from the 140 MWs of solar power projects commissioned by them in a commendable time frame of 365 days would be able to light up 2,00,000 Indian homes or approximately 4 times the number of households in New Delhi. From an environmental perspective, Sterling and Wilson has helped in reducing the country’s carbon footprint by decreasing its dependency on coal for captive power generation by 70 tonnes per year, which is the approximate amount of coal required to generate around 140 MW of electricity. Sterling & Wilson has also been ranked the top solar engineering, procurement and construction (EPC) company in India by the Hong Kong-based IHS Research, a market research firm. The India and global lists put the company ahead of well-entrenched Indian solar EPC players such as L&T ECC Solar, Mahindra EPC and Moser Baer.

Sterling and Wilson Pvt. Ltd., part of Shapoorji Pallonji Group and one of India’s leading solar EPC companies with over 350 MW of solar projects spread across 13 states is close to commissioning more than 140 megawatts (MW) of solar power generation plants in India for the financial year 2014 – 2015.   • Section 79 (3)(b) of IT Act, 2000 determines the liability of online portals providing a platform for free speech and expression of views for internet users
  • The controversial Section 79 (3)(b) had till now required online platforms to immediately take down ‘unlawful content’ upon being notified by an aggrieved party and in the event of failure to do so, the portalsrisked losing immunity from liability in such cases
  • Law firm Saikrishna & Associates challenged Section 79(3) (b) of the IT Act, 2000 and argued that the section unfairly holds the online platforms responsible for views of its user
  • As a consequence, now under Section 79(3)(b), taking down of content or IT resource will now be possible only under a court order or a government order.
 
The Supreme Court of India gave much-needed relief to online portals by rewording the controversial Section 79 (3)(b) of the Act, which determines the liability of online companies, such as Google, Facebook and Twitter, which provide platforms for free speech and expression of views for internet users.
 
The move by Supreme Court, which is being termed as historical, will provide relief to online portals from frivolous notices asking them to take down any content which is found objectionable by any quarter of the society.  Now, under Section 79(3)(b) of the Information Technology Act taking down of content or IT resource will now be possible only under a court order or a government order.
 
The Internet & Mobile Association of India (IAMAI) a not-for-profit industry body which represents the online and mobile value added services sectors and includes major internet players such as Google, Facebook, Flipkart etc., as its members had also filed a Writ Petition which was clubbed with the other petitions heard by the Supreme Court. IAMAI was represented before the Supreme Court Bench by Counsel Saikrishna Rajagopal from Saikrishna & Associates who challenged the constitutional fitness of Section 79(3) (b) of the IT Act, 2000 and argued that the section unfairly burdens online platforms for views of its user.
 
Speaking about the judgment, Saikrishna Rajagopal said, “The Honourable Bench recognized the need to provide a safety net to online platforms from an aggrieved party. The dilution of Section 79 (3)(B) guarantees that online platforms will no more be pressurized by any vested interests until there is a court or government order to take down any disputed comment available online. This landmark judgment will ensure that safety of platform providers for free speech and expression will not be compromised at any cost.”
 
Mr. Rajagopal was assisted in his arguments by a senior team of lawyers including J. Sai Deepak, Abhinav Mukherji, Savni Dutt and Rachel Mamatha.
 
The controversial Section 79 (3) (b) of the Act had till now required online platforms to immediately take down ‘unlawful content’ upon being notified by an aggrieved party and in the event of failure to do so, the companies risked losing immunity from liability in such cases. It was brought to the Honourable Bench’s notice that it wasn’t always possible for these online media platforms to assess the complex legal and factual issues that may be involved in coming to a conclusion of whether particular content is unlawful or not.
 
The legal team headed by Mr Rajagopal argued that79 (3) (b) forced online platforms to exercise court-like’ functions in order to avoid liability. Consequently, the requirement by the Supreme Court that a Court order should be produced in order for an intermediary to take down allegedly unlawful content, is perhaps one of the most significant contributions of this landmark judgment.  “The further qualification by the judgment that the Court order or the direction from the appropriate Government, must relate to one of the specific grounds of Article 19 (2) of the Constitution, is an objective safety valve that ensures any restriction on free speech to be limited to the grounds expressly recognized by the Constitution of India” added Mr Rajagopal.
